Code section 3.01.009 makes it unlawful to maintain, harbor, or cultivate six or more hives of bees within 75 feet of any residence or place of business other than the beekeeper's own. Five hives or fewer carry no setback, so small backyard beekeeping is permitted. Separately, keeping bees in any manner or number that creates a nuisance is prohibited. Texas has an established Africanized honey bee population, so managed European stock is recommended, and the Texas Apiary Inspection Service registers beekeepers statewide. Qualifying beekeeping operations can obtain agricultural valuation in Texas.
Six or more hives inside the 75-foot setback, or any nuisance hive, must be removed. Fines follow the general penalty in section 1.01.009, each day a separate offense.
