Clearwater cannot restrict dogs by breed under Florida Statute 767.14 as amended in 2023, but enforces individual dangerous-dog rules under Chapter 8 based on behavior.
Effective October 1, 2023, Florida law (SB 942 amending FS 767.14) preempts cities and counties from adopting or enforcing breed-specific bans on dogs, including pit bulls. Clearwater therefore regulates dangerous and aggressive dogs based on individual behavior under Chapter 8 of the City Code together with Florida Statute Chapter 767. A dog declared dangerous after biting, severely injuring, or repeatedly chasing must be confined in a secure enclosure, muzzled and leashed in public, posted with warning signs, and the owner must carry liability coverage. Public housing authorities and HOAs are similarly restricted from breed bans, though insurance carriers may still impose private limits.
