Summary

O'Fallon has no breed ban. Instead, the Chief of Police can declare any animal dangerous based on its conduct, such as a severe bite or a fighting history, and dangerous animals must then be registered, muzzled or confined, and marked with warning signs.

The Chief of Police or his/her designated representative shall classify any animal with the following characteristics as a dangerous animal for purposes of this Chapter: 1. Any animal that has inflicted a severe or fatal injury on a human on public or private property. The term "severe injury" means any physical injury resulting directly from an animal's bite or attack, which results in broken bones or lacerations requiring stitches or hospitalization. ... 4. Any animal owned or harbored primarily or in part for the purpose of fighting or any animal trained for fighting. 5. Any animal that has been deemed fierce/dangerous by the City or any other government entity.

Full Breakdown

035(A) authorizes the Chief of Police or a designated representative to classify any animal as a dangerous animal, regardless of breed, if it has inflicted a severe or fatal injury on a human, attacked or bitten a domestic animal without provocation to a degree requiring veterinary attention, killed a domestic animal, livestock, or poultry off the owner's property without provocation, been owned or trained for fighting, or been deemed fierce or dangerous by the City or another government entity. Severe injury is defined as a bite or attack causing broken bones or lacerations requiring stitches or hospitalization, and the victim must supply photographic proof or medical records.

The owner gets written notice within five working days and may request a hearing before the Municipal Judge within five working days of that notice; pending the hearing the animal must be confined as if already dangerous. 035(H), the owner must register the animal with the Chief of Police, keep it in a locked enclosure at least five feet by ten feet with secure sides and a secured bottom or twelve inches of buried fencing, muzzle and leash it outside the enclosure, display a warning sign visible from the roadway, and notify police within 24 hours of a sale, death, address change, or escape. 035(G)(1).
