Idaho Falls City Code 5-6-10 makes it unlawful to let a dog run at large on any public street, sidewalk, park, or on private property without permission. Under Idaho Falls City Code Title 5, Chapter 6 (Dog Control), Section 5-6-10(C) makes it unlawful for any owner or keeper to permit a dog to be at large on any public street, alley, sidewalk, park, or place, or on private property without the owner's or occupant's permission. Section 5-6-1 defines 'at large' as a dog off the owner's property and not under restraint or control. 'Restraint' means the dog is confined within a structure or fenced yard, secured by a leash, lead or chain, or confined within a vehicle so it cannot escape. The code does not specify a maximum leash length for ordinary dogs, but for dogs classified as 'at risk' (5-6-13) or 'dangerous' (5-6-14), the leash must be no more than four feet (4') long when off the owner's property. Section 5-6-6 declares all dogs found at large to be public nuisances, and police or animal control officers shall impound them in the Animal Control Shelter. Section 5-6-16 separately requires dog owners to immediately clean up and dispose of dog feces left on public or another's private property. The Mayor may authorize designated off-leash training/exercise areas where dogs need not be leashed but must remain under control by whistle, voice, or other command (5-6-10).
A violation of Section 5-6-10 is an infraction punishable by a fine set by Council resolution; a second violation within one calendar year is a misdemeanor. Dogs found at large are declared public nuisances and may be impounded, with the owner liable for impound and boarding fees before redemption.
