Idaho Falls City Code Title 5, Chapter 6, Section 5-6-7(A) makes it unlawful to maintain more than two (2) dogs on the premises of any one dwelling or business property, except where accommodation is required under Idaho or federal law or where allowed by the Zoning Code or the chapter. To exceed two dogs, a resident may apply for an Annual Additional Dog Permit under 5-6-7(B), which allows up to three (3) additional dogs for a total not to exceed five (5). The application goes to the Clerk and requires a non-refundable annual fee, identification of each dog (breed, name, license number), proof of spay/neuter where applicable, a depiction of fencing, kennels, and runs, written permission from the property owner, and a signed agreement allowing the City to inspect the property (including the dwelling interior) between 8:00 a.m. and 5:00 p.m. on any day. Before approval, an animal control officer inspects the location to verify it is sanitary and safe and that escape or nuisance is unlikely (5-6-7(B)(4)). A permit issues when approval is not reasonably likely to create a public nuisance and may be denied or revoked, with appeal rights to the Animal Control Review Board and then City Council. Idaho Falls City Code does not set a numerical limit on the number of cats per household; cats are instead regulated by nuisance behavior under Section 5-6-11.
Keeping more than two dogs without a permit violates Section 5-6-7(A) and is an infraction punishable by a Council-set fine; a second violation within one calendar year is a misdemeanor. A permit may be summarily denied or revoked if an officer certifies an immediate danger to life or health (5-6-7(B)(6)).
