Jackson, NJ Building Safety: Building Permits (2026)

Section 244-11C of the Township Code states plainly that no building or structure shall be erected, restored, added to or structurally altered until a permit has been issued by the Construction Official, and that all applications must comply with the requirements of the Building Code; critically, it adds that no building permit can be issued unless the applicant has first secured a development permit. That development permit, defined in § 244-11A, must be obtained from the administrative officer before a building permit is issued for construction, erection or alteration of any structure or sign, before a change in use of a structure or land, or before any alteration of a parcel's natural condition.

Once construction is complete, § 244-11D bars occupancy of any building or structure until the Construction Official issues a certificate of occupancy, which for changes of ownership, use or new construction (other than one- and two-family homes) also requires sign-off from the Jackson Township Bureau of Fire Prevention. No certificate of occupancy can issue until required site improvements are installed. Enforcement of the permit scheme falls to the administrative officer under § 244-13, who has authority to inspect buildings, plans and premises and to order in writing the correction of any condition found in violation of the chapter, keeping monthly records of permits issued and violations reported to the Township Committee.
