Jackson, NJ Building Safety: Childcare Center Rules (2026)

Jackson Township treats child-care centers, nursery schools and day-care centers as a conditional use rather than a use permitted outright, so an operator must secure conditional-use approval from the Planning Board on top of any zoning district's base requirements. Township Code § 244-114B sets the minimum lot area at one acre, while every other lot and building bulk requirement of the underlying zoning district still applies. Accessory buildings serving the center must sit at least 20 feet from rear or side property lines under § 244-114C and can never stand inside the required front-yard setback or ahead of the principal building's front line.

All interior areas used by children must be on the principal entrance floor or a level no more than half a story above or below finished grade, per § 244-114D, and § 244-114F bars basements from being used for child care, classrooms or recreation entirely. Outdoor recreation space must total at least 100 square feet per rated building capacity and be entirely fenced or otherwise protected from hazards, traffic and driveways under § 244-114E. Section 244-114G requires all loading and unloading of children to happen on site, never in a public street right-of-way, and § 244-114H forbids any residential dwelling facilities inside the center.

Beyond the Township's zoning conditions, § 244-114I requires the use to be licensed by the Division of Youth and Family Services within the New Jersey Department of Human Services, layering state child-care licensing on top of the local site standards. An applicant must also submit a statement under § 244-114A describing the full particulars of the proposed use, activities and building before the Planning Board will consider conditional-use approval.
