Rochester Hills, MI Building Safety: Building Permits (2026)

Section 18-41 adopts the Michigan Building Code, filed by the state construction code commission on May 6, 1974 under Public Act No. 230 of 1972 (MCL 125.1501 et seq.), together with Sections 10 through 13 of that Act, which govern building-permit applications, fees, issuance, plan changes, stop orders and final inspection notices. Complete printed copies of the code are kept on file at the office of the city clerk for public inspection. Section 18-42 designates the Department of Building as the enforcing agency, and its director and inspectors may issue municipal civil infraction citations.

An applicant who is refused a permit, or who receives any other adverse decision under the code, may appeal in writing to the Construction Board of Appeals under Section 18-43; fees for building-department and board-of-appeals services are set out in Article V of Chapter 54 per Section 18-44. Construction under a validly issued permit is limited to 7:00 a.m. to 8:00 p.m., Monday through Saturday, excluding holidays, under Section 18-9; the permit holder is responsible for any contractor's violation of that restriction. Section 18-10 bars Sunday and holiday construction without the mayor's special written permission, unless the work is on an existing single-family home with no neighbor complaints, or there is no occupied home within 1,000 feet.
