Lafayette, IN Building Safety: Carbon Monoxide Detectors (2026)

Section 705, Carbon Monoxide Alarms and Detection, was added to Lafayette's Property Maintenance Code with the rest of the 2024 International Property Maintenance Code, adopted at Lafayette Municipal Code § 13.03.010 by Ord. No. 2025-50 on Nov. 3, 2025. Section 705.1 sets the placement rule: an alarm is required within or near each separate sleeping area and on each level of a dwelling, mirroring the layered coverage the same code chapter requires for smoke alarms in the adjacent § 704 series. Section 705.2 sets the maintenance duty: carbon monoxide alarms and carbon monoxide detection systems must be maintained and tested annually, and any unit that becomes inoperable or begins producing an end-of-life signal must be replaced.

Unlike the smoke alarm rules in § 704.7.1, which fix a 10-year replacement point tied to the manufacture date, § 705.2 ties CO alarm replacement to the device's own failure or end-of-life signal rather than to age alone. Enforcement follows the same Property Maintenance Code process used for the rest of Chapter 13.03: a notice of violation issued under § 104.2, an order consistent with Lafayette Municipal Code § 13.05.060, and prosecution under Chapter 13.05 if the owner does not correct the deficiency. Section 104.4 caps the fine at $1,000 for a violation not otherwise assigned a specific penalty, with a separate offense for each day the violation continues, and § 104.5 preserves the city's separate authority to seek abatement in court.
