Clarkstown, NY Building Safety: Electrical Permits (2026)

Chapter 133 was enacted under the Municipal Home Rule Law specifically to regulate electrical installations in the area of the Town outside of its incorporated villages, safeguarding life and property from hazards caused by improper wiring. Section 133-2 authorizes and deputizes the chief inspector and duly appointed inspectors of the Town-approved electrical inspection agency to inspect and reinspect electrical installations, at no cost or expense charged against the Town. Under § 133-5, it is a violation to install or alter electrical wiring for light, heat or power on any property in the Town until an application for inspection has been filed with the New York Board of Fire Underwriters, and it is likewise a violation to connect that wiring to any power source before a temporary certificate or certificate of compliance is issued by the Board of Fire Underwriters.

Section 133-3 requires the inspector to report any violations or deviations from the electrical provisions of the New York State Uniform Fire Prevention and Building Code to the Building Inspector, who enforces the chapter, and states that no certificate of occupancy may be issued until a certificate of compliance for the electrical work has been filed with the Building Inspector. Section 133-4 lets the Building Inspector suspend or permanently remove an approved electrical inspection agency from the Town's list if it fails to perform its duties competently.

Violations of Chapter 133 are punishable under § 133-6 by a fine of up to $1,000 or imprisonment of up to one year, or both, with each day of continuing violation a separate offense.
