Clarkstown, NY Building Safety: Plumbing Permits (2026)

Chapter 212 of the Clarkstown Code consists of a single historical note explaining that the applicability of the New York State Uniform Fire Prevention and Building Code, including the State Uniform Code applicable to plumbing, was accepted by the Town Board on 11-6-1952. The Town never wrote its own plumbing code; it adopted the state's by reference nearly seven decades ago, and that adoption still controls today. Because plumbing work falls under the Uniform Code, it is permitted the same way as any other regulated construction: § 109-4A of Chapter 109 (Building Construction Administration, rewritten in 2022) requires a building permit for any work which must conform to the Uniform Code, and bars starting that work without first obtaining a building permit from the Town.

The Code Enforcement Officer, appointed under § 109-3, reviews and approves permit applications and collects the fee set under § 109-19's fee schedule established by Town Board resolution. There is no freestanding 'plumbing permit'; plumbing installation, repair, or alteration is folded into the general building-permit process administered by the Building Inspector's office. Work performed without the required permit, or in violation of any permit condition, exposes the responsible party to the penalties in § 109-18C: a fine of up to $2,500 per day for a first offense, escalating into a five-figure range for repeat offenses within 18 months, plus possible civil penalties and injunctive relief in Supreme Court.
