A. Sustainability and Resilient Development Incentive: ... 2. Eligibility: A project seeking the sustainable and resilient development incentives established in this Subsection A shall be located in a Mixed-Use or Industrial zone district and shall satisfy at least one (1) of the following two (2) options below: a. Option 1: Demonstrate compliance with at least four (4) of the following six (6) criteria: ... b. Option 2: Submit proof acceptable to the City that the project is being reviewed and expects to receive certification by the following verified third-party sustainability programs: (1) Silver Certification by the U.S. Green Building Council (USGBC) Leadership in Energy and Environmental Design (LEED) rating system; (2) Another verified third-party sustainability program producing equal or greater sustainability benefits as LEED Silver Certification, as determined by the Manager.

A, Sustainability and Resilient Development Incentive, is open only to projects in a Mixed-Use or Industrial zone district and offers two paths. 1 BD+C Optimize Energy Performance credit. Option 2 instead accepts proof that the project is being reviewed for, and expects to receive, Silver Certification from the USGBC's LEED rating system, or an equivalent third-party sustainability program as determined by the Manager. Projects that qualify under either option, or under the separate Transit-Oriented Development standards in Subsection B, can earn the incentives in Subsection C: one additional floor of height, capped at 12 feet, in the MX-M zone district, or two additional floors, capped at 24 feet, in MX-L or MX-I, plus a 10 percent reduction in required off-street parking.
The height bonus cannot be used within 75 feet of a property line adjacent to lower-density residential zoning, and the Manager determines compliance under Subsection D.
Violations & Fines
This is an opt-in incentive program, not a citywide mandate, so skipping it carries no penalty. A project that claims the added height or parking reduction but is later found not to meet the certification or criteria it relied on can lose that bonus during Development Plan or Building Permit review, and, because Article 4 names no separate fine, any misrepresentation in the application is subject to City Code § 1.1.201's general penalty: up to $2,500 and up to 189 days in jail through Municipal Court.
