Summary

Maricopa has no mandatory green building code: its Sustainable Development Incentive Program lets developers earn expedited review, extra building height, reduced setbacks, or reduced parking by voluntarily including qualifying sustainable design features.

A project must include the specific number of sustainable development features listed in Table 18.125.030 to obtain development incentive. The following table lists the specific incentives that can be granted by the zoning administrator and requirements necessary to receive each incentive. The qualifying sustainable development incentives are described in MCC 18.125.040. The award levels are cumulative. If a proposed project meets the number of requirements listed in the “Requirements” and “Additional Requirements” columns, then a project may receive the incentive in the “Development Incentive” column. +----------------------------+--------------------------+-----------------------+---------------------------+ | Development Incentive | Description | Requirements | Additional Requirements | +----------------------------+--------------------------+-----------------------+---------------------------+ | Expedited Zoning | Development review | Development must | Sustainable feature | | Clearance/Development | permit may be expedited | achieve 9 out of | #14 required. | | Review Permit | administratively, | the 17 sustainable | | | | planning and zoning | development features. | | | | commission not required. | | |

Full Breakdown

The program is entirely voluntary under MCC 18.125.020: no development is required to build green. Projects that incorporate a set number of the 17 listed sustainable features (LEED certification, cool roofs, rainwater harvesting, solar parking lights, rooftop solar, and more) can earn incentives from the zoning administrator: 9 features unlocks expedited review with no planning and zoning commission hearing, 7 features allows up to 15 feet of extra building height, 5 features allows a 5-foot setback reduction, and 3 features allows up to a 20 percent parking reduction.

Violations & Fines

Not applicable: this is a voluntary incentive program with no compliance mandate; developers who skip it simply build under standard zoning rules without the incentive.
