NYStretch layers tighter envelope, lighting and HVAC efficiency requirements on top of the base state Energy Conservation Construction Code; by folding it into the Building Official's enforcement mandate, New Rochelle applies those tighter standards to permitted work citywide rather than leaving them optional.
Compliance is checked at the permit-review stage, when plans must demonstrate conformance with the State Code, and again on site: Section 111-18A(5) requires that all structures, additions and new equipment requiring compliance with the New York State Energy Conservation Code be inspected and approved during the course of construction and upon completion. A project cannot obtain its certificate of occupancy under Section 111-16 until that energy code inspection, along with every other required inspection, has been signed off by the Building Official. There is no separate green-building permit or fee schedule; NYStretch compliance rides on the same building permit application, plans and inspection process used for every other trade covered by Chapter 111.
Violations & Fines
Work that fails an energy code inspection cannot be covered or concealed and cannot receive a certificate of occupancy or compliance under Sections 111-16 and 111-18 until it is corrected and re-inspected. Proceeding without the required energy code sign-off exposes the permit holder to the Building Official's general enforcement powers under Section 111-6, including stop-work action, and continued occupancy or use in violation of the code is itself a violation under Section 111-3.
