Section 9-1-33.4 defines the maximum height of a residential building as the vertical distance from ground level to an imaginary plane running parallel to the ground; the building cannot penetrate that plane. For every residential district listed in Table 3.2, RS-1 through RS-4, RP, RA and RM, that plane sits 35 feet above ground level, so the citywide residential cap is a flat 35 feet regardless of district. The community development director determines "ground level" as the lower of two readings: the finish grades at the exterior walls of the building, or the existing grades on the site, whichever is lower relative to sea level, which prevents a builder from importing fill to artificially raise the measuring point.

Section 9-1-33.3 carves out narrow roof projection exceptions: chimneys, roof vents, finials, spires and similar architectural features that do not add usable floor space may rise up to 3 feet above the 35-foot plane, but living space and habitable rooms may not. On sloped lots, Section 9-1-33.6 changes the measuring method rather than the number itself; height there is measured with a plumb line from the top of the structure straight down to the finish grade directly below, and a main building or accessory structure proposed on or cantilevered over a 2:1-or-steeper slope over 10 feet high needs an approved minor adjustment with findings that the site has unusual topography or lot configuration.
