Building height limits are set in each zoning district chapter. In the R-1 Single-Family Residential District (LEMC 17.76.100), the maximum building height is 30 feet, except for accessory structures; for split levels, no continuous vertical section may exceed 32 feet, and the Planning Commission may approve greater heights for subterranean garages. In the R-3 High Density District (LEMC 17.84.100), the maximum is also 30 feet, with no split-level section exceeding 30 feet. Accessory structures have separate R-1 limits: Group I sheds under 120 square feet may not exceed six and one-half feet, and Group II carports and patio covers may not exceed 15 feet (LEMC 17.76.040).
Exceeding the district height limit without an approved variance or required Planning Commission approval is a zoning violation. Remedies can include redesign, reducing the structure height, or removal of the non-conforming portion, plus after-the-fact review.
