South Fulton's Zoning Ordinance Sec. 403.04 and Table 4-1 set maximum building heights by district. Residential districts R-1 through R-6 and R-5A cap principal buildings at 40 feet. The 'A' apartment district allows 45 feet or 3 stories (whichever is higher), and A-L allows 60 feet or 4 stories. Office-Institutional (O-I) and C-1/C-2 commercial allow 60 feet or 4 stories; industrial M-1/M-2 allow 100 feet or 8 stories. Sec. 403.04(b) exempts certain structures from district height limits, including spires, belfries, cupolas, domes, water storage tanks, cooling towers, chimneys, rooftop mechanical penthouses, smokestacks, flag poles, silos and grain elevators, and fire towers. Private and special schools may be erected to 60 feet, and churches, temples, and other places of worship to 75 feet (Sec. 403.04(b)(10)–(11)); for each foot such buildings exceed the district limit, an additional foot of side and rear setback is required (Sec. 403.04(c)). In the Cedar Grove overlay (Table 4-2), residential dwellings are limited to 40 feet, civic/institutional to 50 feet, nonresidential to 45 feet, and multi-family/mixed-use to 60 feet. In large-scale retail (Sec. 407.03(m)), height is capped at 2 stories / 35 feet (3 stories / 50 feet for urban-infill).
Exceeding the district height limit without a variance is a zoning violation; CDRA may deny permits or certificates of occupancy and require modification. Variances proceed under Article 8.
