Summary

Bloomfield Township bars any adult use that offers live entertainment. Other adult uses need Planning Board authorization and must sit at least 1,000 feet from any existing adult use, house of worship, school, school bus stop, playground or place of public resort and recreation, and from any area zoned for residential use.

(5) Adult uses, as defined in § 315-6, while permissible, may be inimical to the public health, safety, morals or welfare if located without due consideration of their conditions or surroundings. In consideration of the fact that two such establishments are already located in the Township, no adult use offering live entertainment is permitted. The location, relocation or establishment of other adult uses shall be permitted upon authorization of the Planning Board in accordance with the following standards: ... (b) Location. No person shall operate nor shall any record owner of a premises permit the operation of such an establishment within 1,000 feet of any existing adult use or any existing church, synagogue, temple or other place of public worship or any elementary or secondary school or any school bus stop or any municipal or county playground or place of public resort and recreation or within 1,000 feet of any area zoned for residential use.

Full Breakdown

Section 315-39B(5) of the Bloomfield Township Code, in the conditional uses article, regulates adult uses. Section 315-6 defines an adult use as any use or business establishment that provides access to media, materials, clothing, paraphernalia or entertainment with content that is sexually explicit, designed to titillate, or prohibited from being viewed by minors by state law or regulation. The Code notes that two such establishments already operate in the Township, and no adult use offering live entertainment is permitted; § 315-37G(5) separately lists adult uses offering live entertainment among the specifically prohibited uses. Every other adult use needs Planning Board authorization and has to meet each standard in the subsection.

Location is the main limit. No person can operate, and no record owner can permit the operation of, an adult use within 1,000 feet of any existing adult use, house of worship, elementary or secondary school, school bus stop, municipal or county playground or place of public resort and recreation, or any area zoned for residential use. Distance is measured in a straight line without regard to intervening structures, from the nearest portion of the building used as part of the adult premises to the nearest property line of the protected use.

Site standards follow. Parking is one space for two fixed seats, one space for every 150 square feet of leasable gross floor area, or one space for every two persons at the maximum occupancy set by the Fire Official, whichever is greater. The business must be screened to impede views of its interior, and all openings, entries, windows and doors must be located, covered or screened to prevent a view from any public place. One sign is allowed, up to 40 square feet, carrying only the name and address. No adult use can share a building with any residential use. Opening, relocating or converting an existing location, even temporarily, counts as establishing an adult use, and the applicant must submit a security plan for the reviewing Board's approval. The subsection does not permit obscene materials as defined in N.J.S.A. 2C:34-2.

Violations & Fines

Violating the subsection violates Chapter 315. Under § 315-53 the Township can seek an injunction, the Zoning Officer or Construction Official can issue stop-work orders and deny, revoke or withhold permits, and anyone who aids, abets, authorizes, directs or supervises the violation, including a landowner's officers, agents, employees and contractors, is also guilty. Where no specific penalty is set, § 1-15 allows a fine up to $2,000, imprisonment up to 90 days or community service up to 90 days.

Frequently Asked Questions

Can a strip club open in Bloomfield Township?
No. Section 315-39B(5) states that, because two such establishments are already located in the Township, no adult use offering live entertainment is permitted. Section 315-37G(5) also lists adult uses offering live entertainment among the uses specifically prohibited. Other adult uses can proceed only with Planning Board authorization under the listed standards.
How far must an adult business be from a school or church in Bloomfield Township?
At least 1,000 feet from any existing adult use, house of worship, elementary or secondary school, school bus stop, municipal or county playground or place of public resort and recreation, and from any area zoned for residential use. The distance is a straight-line measurement from the nearest portion of the adult premises building to the protected property line.
What signs can an adult business display in Bloomfield Township?
One sign only, with a maximum size of 40 square feet. The sign can include only the name and address of the establishment. All openings, entries, windows and doors must also be located, covered or screened so no one can see into the interior from any public place.
Does moving or converting a shop count as opening an adult use?
Yes. Under § 315-39B(5)(g)[1], establishing an adult use includes opening the business as a new business, relocating it, or converting an existing business location to an adult use, whether permanent or temporary. The establishment must also conform to all Township regulations and submit a security plan for approval.
