Sec. 5.6.18 of the Unified Development Code defines a sexually oriented business as one providing commercial products or fee-based services directed toward human sexual stimulation or titillation for non-medical purposes, covering adult arcades, bookstores, video stores, cabarets, retail stores, theaters, escort agencies, nude model studios and sexual encounter centers. The Code bars any such business from operating within 1,000 feet of a bona fide religious institution, public library, public playground or school (other than a business college), a residential zoning district, a lot devoted to residential use, a day care center or kindergarten, a nonprofit educational museum, or another sexually oriented business.

Measurement runs in a straight line, ignoring intervening structures, from the nearest wall of the sexually oriented business to the nearest property line of the protected use, or between the closest exterior walls when measuring two sexually oriented businesses against each other. The Code further confines sexually oriented businesses to the B-3, General Business District, and requires the owner or applicant to sign a written statement verifying compliant operation before the city issues a certificate of occupancy. A sexually oriented business lawfully operating as of March 15, 1994 is grandfathered as nonconforming but cannot be enlarged or altered, and if a protected use later locates within 1,000 feet of an already-approved business, that business stays conforming.
