Section 9-3703 makes it unlawful to own or operate a massage facility, or to allow one to operate on your premises, in Commerce City unless all required state and local licenses, including a massage facility license issued under division 7 of chapter 9, are in effect, and violating this section is itself a misdemeanor carrying the Code's general penalties. Section 9-3705 bars a license from anyone under eighteen, any registered sex offender, anyone with a prior conviction for prostitution, sexual assault, human trafficking or domestic violence offenses, and anyone whose massage license or a substantially similar facility license was revoked or surrendered for cause anywhere in the preceding twenty-four months.

Section 9-3706 sets standards of conduct inside every licensed facility: no table or Vichy shower without a separate permit, no use of the facility as sleeping quarters, no touching intended to arouse or gratify sexual desire, mandatory professional attire that is fully opaque and non-transparent, a ban on sex toys or lubricants on the premises, and no operation between 10:00 p.m. and 5:00 a.m. Facility requirements under section 9-3707 add employee identification and massage-log recordkeeping for at least one year, unlocked interior doors except bathrooms and changing rooms, at least forty watts of light in each treatment room, hot and cold running water, and separate dressing and secure storage facilities for clients.

Section 9-3709 makes an ordinary violation a civil infraction prosecuted in municipal court or the city's administrative hearing process, provable by a preponderance of the evidence unless incarceration is possible, in which case the city must prove the violation beyond a reasonable doubt.
