Eagan, MN Business Licensing & Operations: Tattoo & Body Modification (2026)

Section 6.54 defines body art broadly to include tattooing, cosmetic tattooing, body piercing, branding, scarification, subdermal implantation, microdermal anchors, and suspension, and defines a body art establishment as any place, public or private, temporary or permanent, where those procedures are performed for profit or not. Subd. 3A requires a body art establishment license from the State of Minnesota before anyone may operate one in the city, though jewelry and accessory stores that only offer ear piercing with a single-use cartridge piercing gun are exempt, as are medical or dental offices.

Subd. 3B likewise requires every individual technician who performs a body art procedure to hold a state body art technician license. On top of the state licenses, Subd. 4 layers Eagan-specific conditions: the establishment must be located on property zoned for retail as a permitted use, it may not sell or provide alcoholic beverages, and it cannot be open before 7:00 a.m. or after 10:00 p.m. Subd. 5 adopts Minn. Stats. §§ 146B.01-146B.10, the state's body art licensure law, by reference, including its penalty provisions, so violations of the state statute's health, sanitation, and recordkeeping rules are enforceable in Eagan alongside the city's own hours, zoning, and alcohol restrictions.
