Section 4-2S-9 sits in Article S, the wrecker and towing license article, and it defines illegal towing rather than the license itself, which section 4-2S-1 separately requires every wrecker and towing business to hold along with a general business license before operating in the city. Subsection A bars towing a vehicle from any portion of a public street without the consent of the owner or custodian, except when a law enforcement agency directs the tow. Subsection B bars towing from a private road, driveway, or other privately owned land within the city, unless the wrecker was requested by the vehicle's own owner or custodian, or requested by the owner or custodian of the private property, and even then, non-consensual towing from private property is allowed only where the property is posted with signs meeting the article's sign standards in section 4-2S-8, which require signage at least 18 by 24 inches, visible from where a vehicle enters and where it is parked, stating the towing fee and a phone number to arrange the vehicle's release.

Section 4-2S-16 adds that a towed vehicle cannot be hauled to a location greatly in excess of the city limits without the owner's or operator's consent, and section 4-2S-15 requires anyone who immobilizes a vehicle to respond to a release request within half an hour and to wait at least two hours before removing an immobilized vehicle.
