Hoboken, NJ Cannabis Regulations: Buffer Zones (2026)

Section 196-33.1I sets Hoboken's cannabis spacing rules within the zones where these businesses are permitted. Cannabis retail and medical dispensary locations must be at least 500 feet apart, measured from the primary entrance of one location to the next. Separately, no cannabis retailer or dispensary can be located on the same block frontage as a primary or secondary school, and none can sit within 600 feet in any direction of one, or directly adjacent to an early childhood learning facility. The code carves out two exceptions to the 600-foot school buffer: an already-approved medical cannabis dispensary that is seeking a retail license is exempt from the 600-foot distance and adjacency requirement (though it still needs Cannabis Review Board and Planning Board approval for the retail add-on), and any dispensary that applied to the Cannabis Review Board before April 28, 2022, the effective date of that 600-foot requirement, is grandfathered out of it entirely.

A standalone cannabis delivery business operating from an office location is not subject to the spacing provision at all, since it does not sell to walk-in customers on site. These distance rules sit on top of the City's broader conditional-use and zone limits in § 196-33.1G, so a location has to clear both the spacing test and the underlying zoning before it can open.
