Lake Elsinore, CA Cannabis Regulations: Buffer Zones (2026)

Lake Elsinore's cannabis chapter, Chapter 17.156, was adopted by Ordinance 1504 § 5 in 2025 to regulate every stage of the cannabis supply chain: cultivation, manufacturing, distribution, testing, delivery, and retail sale. Section 17.156.050 sets the location rules. Subsection (A) confines cannabis uses to the Limited Manufacturing (M-1) and General Manufacturing (M-2) zoning districts, and subsection (B), the buffer rule, prohibits any cannabis use within 1,000 feet of a school, community center, or park that is already in existence when a complete conditional use permit application is submitted; a sensitive use built after that application is filed does not force the cannabis facility to relocate.

The buffer runs only against the sensitive uses named in the section, schools, community centers, and parks, a narrower list than the residential-district and church buffer used in the City's separate adult-business spacing rule. On top of the buffer, LEMC § 17.156.060 caps the City at no more than 10 cannabis facility permits operating at one time across the M-1 and M-2 districts combined, and every applicant must still obtain a conditional use permit, building permit, certificate of occupancy, and City cannabis business license under § 17.156.070 before opening.

Violations of Chapter 17.156, including siting within the buffer, are declared a public nuisance under § 17.156.150 and are enforceable through the nuisance abatement procedures of Chapter 8.18 LEMC as well as Civil Code § 3494, Code of Civil Procedure § 731, and Government Code § 38773, with each day of a continuing violation treated as a separate offense.
