La Habra, CA Cannabis Regulations: Dispensary Zoning (2026)

La Habra has not opted out of cannabis entirely, but § 18.22.010.A prohibits all commercial cannabis activity, medical and adult-use alike, unless it is expressly permitted under Chapter 18.22, and the city council states its intent to maintain full local control over marijuana businesses and to abate illegal operations. The chapter still allows personal cultivation of up to six living plants per residence, grown indoors or in a fully enclosed accessory structure of no more than sixty-four square feet, with no outdoor growing permitted (§ 18.22.010.B.4).

For commercial operators, § 18.22.080.A confines every permitted commercial cannabis facility to zones the chapter itself designates, and requires a conditional use permit for every location; operators must first make the city's ranked "qualified cannabis applicant list," negotiate a development agreement, and pay the applicable cannabis business tax before applying for the conditional use permit (§§ 18.22.050, 18.22.060). Facilities can co-locate different license types on one parcel only to the extent not prohibited under state law (§ 18.22.080.B), must operate only inside fully enclosed and secure structures inaccessible to minors, and must run a police-chief-approved security plan covering twenty-four-hour cameras, alarm monitoring, controlled entry vestibules and panic buttons (§ 18.22.080.C).

Because permits are capped and awarded competitively rather than issued as of right, the practical effect is a tightly rationed, discretionary path to legal cannabis retail rather than a general commercial use.
