A medical marijuana dispensary, dual licensee facility, marijuana cultivation facility, and marijuana infusion facility is permitted only in the LI and GI districts, provided that evidence has been demonstrated of compliance with all of the following:1.Spacing requirements for medical marijuana dispensaries and dual licensee facilities. Each medical marijuana dispensary and each dual licensee facility shall be separated from the following uses as follows:(a)A minimum distance of 5,280 feet from the nearest registered medical marijuana dispensary or dual licensee facility... (b)A minimum distance of 2,400 feet from:(i)A community residence;(ii)A correctional transitional housing facility; and(iii)A social service facility.(c)A minimum distance of 1,200 feet from the following land uses...(i)A church located in the RS, RM, DR, T3N, T4N, or T5N Districts;(ii)A library;(iii)A school; and(iv)A public park located in the LI or GI districts.

Mesa City Code § 11-31-34(A) permits a medical marijuana dispensary, dual licensee facility, marijuana cultivation facility, or marijuana infusion facility only in the Light Industrial (LI) and General Industrial (GI) districts. Dispensaries and dual licensee facilities must sit at least 5,280 feet (one mile) from the nearest registered dispensary or dual licensee facility, including ones in neighboring jurisdictions, though an existing 'qualified marijuana facility' on a large industrial development (80+ acres) may drop to 1,000 feet if it is set back at least 300 feet from a major roadway and separated from the nearest dispensary by that roadway.
Additional buffers apply: 2,400 feet from a community residence, correctional transitional housing facility, or social service facility; 1,200 feet from a church in the RS, RM, DR, T3N, T4N or T5N districts, a library, a school, or a public park in LI/GI; and 500 feet from a day care/pre-school, a public park outside LI/GI, or an HOA-maintained open space. Cultivation and infusion facilities carry a parallel but separate set of buffers (2,400/1,200/500 feet). Every facility must hold both a valid ADHS dispensary registration certificate/approval-to-operate and a separate City registration filed with the planning division under Chapter 67, renewed annually and non-transferable. m.
Violations & Fines
The Zoning Administrator may revoke a facility's City registration for submitting false or misleading information, failing to pay required fees, or losing the underlying ADHS dispensary registration certificate or approval-to-operate. Upon revocation, the City sends written notice; registration automatically terminates 15 calendar days after notice, and the facility must cease operation within 45 calendar days of the City's written notification.
