Before opening, the operator must first hold a valid Oklahoma Medical Marijuana Authority license, then apply to the city clerk for a retail dispensary business license under the general requirements of Sec 8-1202. Community Development schedules a property inspection, which the applicant must attend, to confirm the structure, equipment and apparatus meet current state and Moore building and fire codes.
The retail establishment must also carry a valid Oklahoma sales tax permit and remit all required state and city sales tax. No on-premises use of marijuana or its derivatives is allowed at the dispensary, and any violation of Sec 8-1203's conditions results in revocation of the retail license. The city manager or a designee may also revoke or suspend the underlying medical marijuana business license for fraud in the application, any violation of a city ordinance, state law or Department of Health rule, or conduct amounting to a public nuisance, after notice and an opportunity to be heard before the city manager.
Revocation of the Oklahoma-issued license triggers automatic revocation of the city license. A nonrefundable license fee and an annual renewal fee, set by the city's fee schedule, apply to every dispensary. Smoking or vaping marijuana on any city property, including parks, vehicles and buildings, is separately prohibited citywide.
