Home cannabis cultivation is illegal throughout Charlotte County. Florida allows medical marijuana only, and even registered patients may not grow their own. Recreational use remains illegal; the 2024 Amendment 3 failed.

A qualified patient or caregiver who cultivates marijuana or who purchases or acquires marijuana from any person or entity other than a medical marijuana treatment center violates s. 893.13 and is subject to the penalties provided therein.
Only medical marijuana dispensaries are allowed. Under Fla. Stat. Β§381.986(11), Charlotte County and Punta Gorda may ban dispensaries or apply pharmacy-equivalent location rules, but may not cap their number if allowed. No recreational sales exist.
