Newport Beach enforces a juvenile curfew under NBMC Chapter 10.28 prohibiting minors under 18 from being in public places during curfew hours. On school nights (Sunday through Thursday), curfew runs from 10:00 PM to 6:00 AM. On weekend nights (Friday and Saturday), curfew runs from 11:00 PM to 6:00 AM. Exceptions include employment, emergencies, and parental accompaniment.
Newport Beach Municipal Code Chapter 10.28 establishes a juvenile curfew for persons under 18 years of age. On school nights (Sunday through Thursday), minors must not be in any public place, establishment, or motor vehicle between 10:00 PM and 6:00 AM. On non-school nights (Friday and Saturday), the curfew begins at 11:00 PM and ends at 6:00 AM. Exceptions to the curfew include minors accompanied by a parent or legal guardian, minors traveling to or from employment with employer verification, minors engaged in an emergency, minors exercising First Amendment rights such as attending religious services or political activities, and minors on the sidewalk directly in front of their residence. The curfew also does not apply to emancipated minors with proper documentation. NBPD officers who encounter a minor in violation of the curfew will attempt to contact the parent or guardian. On the first offense, officers typically transport the minor home or to the police station for parent pickup. The ordinance also imposes responsibility on parents and guardians, who may not knowingly permit their minor child to violate curfew provisions. Business owners and operators may not knowingly allow minors to remain on their premises during curfew hours.
First-time juvenile curfew violations typically result in a warning and parent notification. Subsequent violations may result in citations with fines up to $250 per offense. Parents or guardians who knowingly permit curfew violations may also face citations and fines. Business owners who knowingly allow minors to remain on premises during curfew hours may face separate municipal code violations and fines.
