Lake Elsinore's curfew ordinance, LEMC 9.76.020, makes it unlawful for anyone under 18 to be in city parks, playgrounds, and other public grounds between 10:00 p.m. and 5:00 a.m. A separate daytime restriction bars school-age minors from parks during school hours, 7:00 a.m. to 4:00 p.m., on school days.
Under LEMC 9.76.020(A), it is unlawful for any person under 18 to be present in or upon parks, playgrounds, public grounds, streets, and similar public places between 10:00 p.m. and 5:00 a.m. the following day. LEMC 9.76.020(B) adds a daytime curfew: minors subject to compulsory education may not be in parks or other public places between 7:00 a.m. and 4:00 p.m., or other hours set by the school district, on school days. LEMC 9.76.030 lists exceptions, including minors with a parent, traveling directly to or from school, church, or work, in an emergency, or exercising First Amendment rights. The city operates parks on general sunrise-to-sunset hours, but the codified, enforceable park curfew is the minor curfew in LEMC Chapter 9.76.
A minor who violates the park curfew under LEMC 9.76.020 is guilty of an infraction handled under state juvenile procedures. A parent who permits the violation may be cited under LEMC 9.76.050, and detention costs recovered under LEMC 9.76.060.
