Chapter 5.28 makes it unlawful and a nuisance to maintain any loud, disturbing, unnecessary, unusual, or habitual noise, weighed by level, duration, background noise, the zoning district, proximity to sleeping rooms, and whether it recurs. The code carries no decibel table. The operative test for a data center sits in Zoning Ordinance Section 8.28.030.A: in the M-P district no noise or vibration may be discernible without instruments at any point on a lot line. Sections 8.28.040 and 8.28.050 apply that test in M-1 and M-2 at lot lines abutting a residential district.
A Chapter 5.28 violation is a misdemeanor punishable by a fine up to five hundred dollars, up to thirty days in county jail, or both. Each violation is a separate offense.
