Summary
Dublin sets no decibel limit by ordinance. Municipal Code Chapter 5.28 bans unreasonable noise as a misdemeanor. The zoning performance standards bite harder: noise from an M-P industrial site must not be discernible without instruments at any lot line.
All industrial land uses shall conform to the following standards. Any violation of these standards is a violation of the Zoning Ordinance:
A. Noise or vibration. No noise or vibration, other than related to transportation activities and temporary construction work, shall be discernible without instruments at any point on a lot line of the building site.
B. Radioactivity. No activity, including storage or dumping, shall result in the emission of radioactivity in dangerous amounts.
C. Electrical disturbance. No activity shall cause electrical disturbance adversely affecting the operation of any equipment other than that of the creator of such disturbance.
D. Inflammable or explosive materials. No inflammable or explosive materials shall be produced, used, stored, or handled unless provided at all points with adequate safety devices and procedures against hazards of explosion and all equipment and devices for fire prevention and fire fighting approved by the Alameda County Fire Department.
E. Air pollution. No air pollution or smoke shall be produced which is in violation of the requirements of the Bay Area Air Pollution Quality Management District.
F. Glare or heat. No direct or sky-reflected glare or heat shall be produced which is discernible without instruments at any point on a lot line of the building site.
Full Breakdown
Chapter 5.28 makes it unlawful and a nuisance to maintain any loud, disturbing, unnecessary, unusual, or habitual noise, weighed by level, duration, background noise, the zoning district, proximity to sleeping rooms, and whether it recurs. The code carries no decibel table. The operative test for a data center sits in Zoning Ordinance Section 8.28.030.A: in the M-P district no noise or vibration may be discernible without instruments at any point on a lot line. Sections 8.28.040 and 8.28.050 apply that test in M-1 and M-2 at lot lines abutting a residential district.
Violations & Fines
A Chapter 5.28 violation is a misdemeanor punishable by a fine up to five hundred dollars, up to thirty days in county jail, or both. Each violation is a separate offense.
