26 (§ 9-3-1). Section 9-3-3 requires stormwater system design and construction documents to conform to city-adopted standards and meet federal, state and local discharge quality requirements; storm drain design within city boundaries requires the direct supervision and seal of a Utah registered professional engineer, and site designs must control peak stormwater discharge flow rates using the LID Handbook's calculation methods. Section 9-3-4 requires erosion and sediment control on all construction activities under a stormwater construction permit, including a SWPPP submitted to and reviewed by the city before permit application, and requires post-construction revegetation on a schedule approved by the City Engineer.

Section 9-3-5 requires stormwater infrastructure on private land to carry recorded access easements binding on current and future owners for inspection and repair. Enforcement under § 9-3-7 lets the city issue notices of violation, stop-work orders, citations, compliance orders and cease-and-desist orders, with corrections generally required within 48 hours to 10 calendar days depending on severity as determined by a registered stormwater inspector. Penalties under § 9-3-8 escalate: a first offense may be charged as a class C misdemeanor, a second offense as a class B misdemeanor, both with fines assessable per day per violation, plus civil penalties set by council resolution in the consolidated fee schedule and recovery of the city's investigation, enforcement and maintenance costs, including attorney's fees. Aggrieved persons may appeal under § 9-3-9.
