Fence heights in Orem are governed by Orem City Code Chapter 22 (Zoning), Article 22-14 (Supplementary Regulations), Section 22-14-19 (Fences, Walls and Hedges), read together with Section 22-14-10 (Clear Vision Area). No fence, wall, hedge or similarly enclosing planting or structure may be placed in the required front setback or clear view area of a lot at a height greater than thirty-six inches (36 inches) above finished grade level, to preserve driver and pedestrian sight lines. General fencing elsewhere on the lot is limited to roughly eight feet, and taller fences may require Engineer approval before a permit is issued. Higher enclosures are allowed only for specific recreational uses: fence-type enclosures for tennis courts, sport courts, swimming pools, ball-diamond backstops, batting cages and the like may be erected to a height not greater than twelve feet (12 feet), but may not be placed in a front yard setback and remain subject to the clear-vision rules on corner lots. Orem also bars locating a driveway or drive access within twenty-five feet of an existing fence greater than three feet in height where doing so would put the fence inside the Clear Vision Area associated with that access. Because Orem follows the adopted State Construction Code, a building permit is required for a masonry or concrete fence and for tall fences as noted in 22-14-19.
Fences exceeding the 36-inch front-setback/clear-view limit or the general height cap are a zoning violation enforced by Orem Code Enforcement and the Zoning Administrator. Remedies include written notice, an order to lower or remove the fence, administrative citations and abatement of the nuisance; an aggrieved owner may appeal the Zoning Administrator's decision to the Appeal Authority under Utah law.
