Laguna Niguel does not set cost-sharing rules for shared fences; those are governed by California Civil Code Sec. 841. LNMC 9-1-35.2 does regulate boundary fences where lots differ in grade and where a front yard abuts a neighbor's rear yard.
The Laguna Niguel Municipal Code does not assign who pays for a shared boundary fence; California's good-neighbor fence law (Civil Code Sec. 841) presumes adjoining owners share equally in the reasonable cost of a boundary fence. LNMC 9-1-35.2(c)(3) addresses grade differences: a fence on a property line may be up to eight feet measured from the lot it sits on, but no more than six feet as measured from the adjacent property or street. Where lot orientation places a front yard on one lot against a rear yard on the neighboring lot, the property-line fence may be six feet within the front setback area, subject to the corner sight-distance limits of Sec. 9-1-35.2(c)(6).
Boundary-fence height violations are enforced by Community Development. Cost and maintenance disputes between neighbors are civil matters resolved under Civil Code Sec. 841, not by the city.
