Per the city's building handout, fences and gates not over 42 inches high are exempt from a building permit (though still subject to the California Building Code). Masonry fences and fences over 42 inches require a building permit; the masonry-fence handout notes 42 inches maximum without a permit and 72 inches maximum with a permit. Even when a building permit is not required, other approvals may be needed: fences within the front yard setback or front side yards are likely to require a use permit or design review. Fences exceeding the LNMC 9-1-35.2 height limits require a minor adjustment approved by the director under Sec. 9-1-114.
Building without a required permit can trigger stop-work orders, correction notices, and permit-fee penalties from the Building Division, plus zoning enforcement for over-height fences.
