Laguna Niguel, CA Fence Regulations: Fence Permit Requirements (2026)

Section 8-1-13 amends Chapter 1 of the adopted 2025 California Building Code by revising Section 105.2, 'Work Exempt from Permit.' Item 2 of that exempt list, as locally amended, covers only 'Walls, fences and/or gates less than 42 inches in height,' meaning any fence, wall or gate reaching 42 inches or more triggers the standard building permit process administered by the Laguna Niguel Building Official within Community Development. Because Section 8-1-12 adopts the California Building Code to govern the erecting, construction, alteration and maintenance of all structures in the city, a taller fence must meet that code's structural provisions in addition to whatever else the city requires for the applicable property.

A permit issued for a fence is subject to the same expiration rule as any other building permit: under the amended Section 105.5, it lapses if work does not start within 12 months, though the Building Official may grant written extensions of up to 180 days at a time for justifiable cause. Fences built during a larger remodeling project also intersect with Section 105.8, which lets the Building Official require temporary fencing around a construction site when necessary for public safety or welfare. Building a 42-inch or taller fence without the required permit exposes the property owner to the same enforcement path as unpermitted construction generally: correction through Community Development code enforcement and, under Section 8-1-2, misdemeanor prosecution for building or maintaining the structure contrary to the division.
