Gaithersburg, MD Fire Regulations: Fire Pit Rules (2026)

Recreational fire pits in Gaithersburg are regulated under the Maryland Fire Prevention Code (COMAR 29.06) and Montgomery County fire safety regulations enforced by Montgomery County Fire and Rescue Service. Portable fire pits and permanent outdoor fireplaces are permitted in residential areas provided they meet setback and safety requirements. Fire pits must be located at least 15 feet from any structure, property line, fence, overhead branch, or combustible material. Only clean, dry, seasoned wood or manufactured fire logs may be burned — no trash, leaves, construction debris, treated wood, or plastics. A garden hose connected to a water source, fire extinguisher, or other means of extinguishment must be immediately accessible. Fire pits must not be left unattended. Fires must be fully extinguished before the owner goes inside or to sleep. Wind conditions exceeding 15 mph should prompt extinguishment.
