Gaithersburg, MD Fire Regulations: Outdoor Burning (2026)

Open outdoor burning is largely prohibited in Gaithersburg under Montgomery County fire regulations and the Maryland Fire Prevention Code (COMAR 29.06). The county bans open burning of leaves, yard waste, trash, construction materials, and other debris within its jurisdiction. This prohibition reflects air quality standards under the Maryland Environment Article and fire safety concerns in the suburban-density community. Exceptions include recreational fires in approved fire pits (see fire-pit-rules), outdoor cooking in grills and smokers designed for that purpose, and ceremonial fires with proper permits. Agricultural burning is not applicable within Gaithersburg city limits. Charcoal and gas grills must be operated at safe distances from structures — generally 10 feet from buildings on balconies or decks, though condominium and apartment communities may prohibit charcoal grills entirely on balconies. Montgomery County Fire and Rescue Service may issue temporary burn bans during drought, high wind, or poor air quality days. The Maryland Department of the Environment also regulates open burning under COMAR 26.11.07. Gaithersburg provides curbside yard waste collection as an alternative to burning.
