Georgia Fireworks Safety Act (O.C.G.A. §25-10-1+) preempts local bans on consumer fireworks since 2015 (SB 350/HB 110). Per O.C.G.A. §25-10-2(a)(2), discharge prohibited within 100 yards of hospitals, nursing homes, jails, or electric plants, and prohibited on public roads/rights-of-way and government parks without permit. Fulton County and its cities can apply general noise ordinances on non-holiday days. Atlanta enforces its noise ordinance (Atlanta Code §74-133) outside the protected discharge windows.
