Buena Park is one of the relatively few Orange County cities that still allows 'Safe and Sane' fireworks, defined by reference to Section 12529 of the California Health and Safety Code. According to the City, only fireworks bearing the California State Fire Marshal seal indicating they are 'Safe and Sane' may be used, and they may be discharged within the city only on July 4th of each year, between the hours of 10 a.m. and 10 p.m. Discharge is prohibited on any public property except public streets and rights-of-way, with the specific exception of La Palma Avenue between Western Avenue and El Monte Drive. Fireworks may not be discharged on private property without the property owner's permission. It is unlawful to sell, give away or furnish fireworks to anyone under sixteen except under the direct supervision of an adult, and persons under sixteen may not purchase, possess or discharge fireworks except under adult supervision. The City's updated fireworks ordinance (Ordinance No. 1751, adopted 2025) sharply raised penalties: the fine for possession or use of illegal fireworks is $1,000 for a first violation, $2,000 for a second and $3,000 for a third or subsequent violation. A separate social-host penalty applies to property owners, tenants and organizers who allow illegal fireworks on their property: $2,000, $4,000 and $6,000 for first, second and third violations respectively.
Possession or use of illegal (non-Safe-and-Sane) fireworks draws an administrative fine of $1,000 (first), $2,000 (second) and $3,000 (third or subsequent). The social-host penalty for allowing illegal fireworks on property you own, rent or organize is $2,000, $4,000 and $6,000 for successive violations. Citations may be appealed within 20 days via a Request for Administrative Hearing.
