Summary

Consumer fireworks may only be used in the City of Flagstaff from June 24 through July 6 and December 24 through January 3, under Flagstaff City Code Section 5-02-002-0002, and never within 100 feet of a hospital, school or the border of large City-owned preservation lands.

A. The use, discharge or ignition of permissible consumer fireworks within the City of Flagstaff is prohibited, except as provided in this section. B. The use of permissible consumer fireworks is prohibited within the City limits of Flagstaff except from June 24th through July 6th and December 24th through January 3rd each year. The use of permissible consumer fireworks is also prohibited when a Federal or State agency implements Stage One or higher fire restrictions in any portion of Coconino County in effect for any one (1) or more of the days listed in this subsection. C. The use of permissible consumer fireworks is prohibited within a one hundred (100) foot radius of the border of preservation lands greater than fifteen thousand (15,000) acres that are owned by the City of Flagstaff. D. The use of permissible consumer fireworks is prohibited on public property and within one hundred (100) feet of any hospital or public school. ... ... F. Separately, Section 5-02-002-0003 sets the sale window at May 20 through July 6 and December 10 through January 3, bars sales to anyone under 16, and Section 5-02-002-0004 requires retailers to post a specific warning sign.

Violations & Fines

Failing to comply with any Fire Department fireworks permit requirement is a class three misdemeanor under Section 5-02-002-0002(G). Selling consumer fireworks outside the licensed window, to a minor, or without the required warning sign is also a class three misdemeanor under Sections 5-02-002-0003 and 5-02-002-0004(B), and City police officers or the City Attorney may issue criminal complaints to enforce the fireworks article under Section 5-02-002-0005.
