Oakley is one of a small number of Contra Costa County cities that ALLOWS state-approved Safe and Sane fireworks, sold and discharged only around the Fourth of July window. Fireworks may only be purchased from licensed nonprofit stands within city limits and discharged on private property from late June through July 4. All aerial, exploding, or out-of-state fireworks remain illegal and carry heavy fines. ECCFPD enforces strict prohibition during Red Flag Warnings.
Unlike most Bay Area jurisdictions, Oakley permits Safe and Sane fireworks under a local ordinance that authorizes the California State Fire Marshal-classified products (ground-based fountains, sparklers, snakes, cones, and similar non-aerial, non-exploding devices). Each year the City Council approves a limited number of nonprofit permits for temporary fireworks stands, typically operating from June 28 through July 4. Revenue from these stands supports local schools, youth sports, churches, and service clubs. Residents may discharge Safe and Sane fireworks only on private property with the owner's permission, and only during the designated sales window (ending at midnight July 4 or as specified by ordinance). Discharging on public property, streets, sidewalks, parks, school grounds, or in any undeveloped open space is prohibited and may trigger fines of $1,000 or more. All fireworks not bearing the California State Fire Marshal Safe and Sane seal are illegal, including firecrackers, bottle rockets, Roman candles, aerial shells, M-80s, and anything purchased out-of-state or online. Possession of illegal fireworks is a misdemeanor and may result in a $1,000 administrative fine plus prosecution under Health & Safety Code Sections 12500-12728. ECCFPD and Oakley Police conduct enhanced patrols during the holiday and operate a Social Host ordinance making property owners liable for illegal fireworks discharged on their premises. Minors under 16 cannot purchase or possess fireworks. During Red Flag Warnings or extreme fire weather, the Fire Marshal may suspend all discharge by emergency proclamation. Dispose of used fireworks by soaking in water overnight before placing in a metal trash container.
