Martinez is a "no fireworks" city under Martinez Municipal Code Chapter 8.16. Unlike neighboring communities that permit "safe and sane" fireworks during July 1β4, Martinez prohibits the sale, possession, use, and discharge of ALL fireworks within city limits β including sparklers, fountains, ground spinners, and any device classified as a firework under California Health & Safety Code Β§12500. The ban is driven by two factors: (1) the Shell Martinez Refinery and adjacent petrochemical infrastructure create an elevated ignition-risk zone, and (2) hillside neighborhoods border CAL FIRE-mapped wildfire areas. Contra Costa County Fire Protection District (ConFire / CCCFPD) enforces the ban alongside Martinez Police. Only licensed pyrotechnic operators with state permits (per CCR Title 19) may conduct public displays, such as the city's Independence Day event at the Martinez Marina. Violations are misdemeanors punishable by fines up to $1,000 and/or up to six months in jail. Recent California legislation (AB 2958) allows cities to impose administrative fines up to $5,000 per offense for illegal fireworks. During Red Flag Warnings declared by the National Weather Service, enforcement intensifies.
