Lower Merion, PA Fire Regulations: Smoke Detectors (2026)

Section 119-6 of the Lower Merion Township Code, added in 1994, requires certifications at the point of real estate sale because, as the Board of Commissioners found, purchasers are often unaware of code requirements affecting the property. Subsection B makes it unlawful for an owner to sell, or a purchaser to acquire, a property or interest in one unless the owner first delivers four certifications to the purchaser before settlement: zoning and use classification, curbing and sidewalk repair, smoke detector installation, and building number posting.

Subsection E is the smoke detector certification itself: the owner must certify that smoke detectors have been installed as required by Chapter 78, Fire Prevention, and Chapter 92, Property Maintenance, and that those detectors are properly functioning. Applications for the related certifications go through the Township on forms provided for that purpose, accompanied by a fee set by the Board of Commissioners under Subsection G. Subsection H sets the enforcement teeth: the Township will not register a deed unless the required certifications have been issued and copies furnished with the registration application, and an owner who fails to provide the purchaser with a required certification, where the property in fact failed to meet it, is guilty of violating the section.

Conviction in a summary proceeding carries a civil fine of not more than $600 plus costs of prosecution, on top of any other remedy available at law or in equity. The certification duty sits alongside the separate substantive smoke detector standards enforced directly under Chapters 78 and 92.
