Under the Virginia POA Act, associations may regulate exterior modifications through an architectural review committee or board. Owners must submit plans for changes such as fences, paint, additions, solar panels, and flagpoles. Reviews must follow written standards adopted by the association. Denials require written reasons and owners have a right to appeal to the full board. Solar energy devices have specific statewide protections under VA Code ยง67-701 limiting HOA prohibition. Display of the US flag on reasonable flagpoles is protected under VA Code ยง55.1-1819.1.
