Enforcement of covenants, conditions, and restrictions in Chesapeake HOAs is governed by VA Code ยง55.1-1819. Before imposing a charge, the association must give the owner written notice and an opportunity for a hearing. Fines are capped at $50 for a single act and $10 per day for continuing violations up to 90 days. Suspension of recreational facility access and voting rights is permitted in accordance with bylaws. The association may also seek injunctive relief in Chesapeake Circuit Court. Owners may cure violations during the notice period to avoid fines.
