City Code Section 11-601.1, the permitted-use table for Chapter 11-600 Residential Districts, lists day care under Congregate Living and lets it operate by right, with a 'P' designation, across the LDR-1, LDR-2, MDR, HDR, and LDR-3 districts for the smallest tiers of licensed care. A family day care facility licensed under Minnesota Rules parts 9502.0315 to 9502.0445 and serving 10 or fewer children is permitted in all of those districts, as is a group family day care under the same Minnesota Rules serving up to 14 children.

The same table separately permits a state-licensed day care facility with a licensed capacity of 12 or fewer persons in every residential district but Mobile Home. Once a facility's licensed capacity rises to 13 to 16 persons, the table marks it 'NP' (not permitted) in LDR-1, LDR-2, MDR, and Mobile Home, and allows it only in the High-Density Residential (HDR) district. Because these are listed as permitted uses rather than conditional uses, an operator running within the licensed-capacity limits does not need a conditional use permit or public hearing before the Planning Commission, only the underlying state day care license and compliance with the district's other residential standards, such as parking and accessory structure rules in Section 11-601.
