San Clemente permits small and large family day care homes in residential dwellings. Under California law these homes are treated as a residential use, so the city cannot require a conditional use permit or treat them as a business; state licensing through Community Care Licensing applies.
Family day care homes are addressed in Zoning Code Section 17.28.100 (Child Day Care Facilities). Small and large family day care homes are permitted in a detached single-family dwelling, townhouse, or dwelling unit where zoning allows residential uses, reflecting the state rule that a family day care home is a residential use of property. Under the California Child Day Care Facilities Act (Health and Safety Code Sections 1596.70 and 1597.40 et seq.), a small home (up to 8 children) must be treated as an ordinary residence, and a large home (up to 14 children) cannot be required to obtain a conditional use permit beyond what state law allows. Operators must be licensed by California Community Care Licensing.
Operating a family day care home without the required state Community Care Licensing license, or exceeding licensed capacity, is a state enforcement matter. The city cannot bar a licensed home, but non-discretionary parking, safety and fire-clearance standards still apply.
