San Clemente allows home occupations as an accessory use in any residential dwelling in any zone, provided the business stays incidental to the home. The activity may not change the residential character of the dwelling or occupy more than 20 percent of the habitable floor area.
Home-based businesses are governed by the Zoning Code (Title 17), primarily Section 17.16.140, Home Occupation Permits. A home occupation is permitted within a legal residential dwelling in any zone but must stay incidental and accessory: it may not change the principal residential character of the dwelling and may not involve more than 20 percent of the habitable floor area. To keep the use unobtrusive, the code limits outside employees, prohibits significant added traffic, restricts on-premise direct sale of goods, and restricts signage. A conditional use permit may be needed to operate outside an enclosed structure. The goal is protecting residential quality of life while permitting low-impact businesses. Applicants must obtain a permit and a business license first.
Operating a home occupation that exceeds the 20 percent floor-area cap, changes the residential character, generates significant traffic or on-site customer sales, or lacks the required permit and business license, is a zoning violation enforceable by the Community Development Department.
