Municipal Code Sections 18.20.700 through 18.20.730 govern community care facilities, including family day care homes. Section 18.20.720 splits the use into a small family day care home, serving six or fewer children plus up to two school-age children who live at the home, and a large family day care home, serving nine to 14 children including resident children under 10. Section 18.20.730.A permits small family day care homes in every residential zone subject only to the zone's ordinary development standards, no discretionary permit required. Large family day care homes are also permitted in every residential zone, but Section 18.20.730.B requires the Zoning Administrator to approve a modified conditional use permit under Section 18.38.050.G before one can open, based on compliance with the zone's development standards plus several additional conditions: the facility must sit at least 500 feet from any other large family day care home or child day care center; the owner must provide and keep available at least two covered and two open parking stalls, preferably on a driveway; a use fronting an arterial or collector roadway needs City Traffic Engineer review and approval; the use cannot materially reduce neighbors' privacy or create nuisance noise; and the operator must provide at least 75 square feet of outdoor activity space per child who is not an infant, a requirement the City may waive if a public park, school or other open area sits nearby. Child day care centers, by contrast, need a Planning Commission conditional use permit in residential, commercial and industrial zones alike under Section 18.20.730.C.
