Laguna Niguel requires a Home Occupation Permit (Form 210) to run any business from a residence. The applicant certifies compliance with eight standards under Zoning Code Section 9-1-35.10, and the Planning Division approves or denies the permit.
Home occupations are permitted in all residential zoning districts as an accessory use, subject to a Home Occupation Permit under Zoning Code Section 9-1-35.10. The applicant files Form 210 with the Planning Division and initials eight conditions: the use must be incidental; only residents may work in it; it must be within the living area or attached garage and use no more than 25 percent of combined floor area; not in a detached structure; no signs, outdoor storage, or customer vehicles; no equipment causing radio, TV, or line-voltage interference; no hazardous materials or excess dust, noise, glare, or odors; and no sales except mail-order, without customer pickup or delivery. The applicant signs an affidavit accepting the restrictions.
Form 210 states that any violation of the listed restrictions causes the Home Occupation Permit to become null and void. Operating without a permit, or breaching a condition such as employing non-residents, subjects the resident to zoning enforcement.
